These Terms of Service ("Terms") govern your use of helendelovely.com (the "Site"), operated by Helen DeLovely LCSW PLLC. The practice operates publicly as The Healing Haven and is owned and operated by Helen DeLovely, LCSW. By using the Site, you agree to these Terms.
The Site provides general information about Helen DeLovely's therapy practice. Reading the Site, submitting a contact form, or otherwise interacting with it does not create a clinical, professional, or therapist-client relationship. No content on the Site is medical advice, mental health advice, diagnosis, or treatment.
A clinical relationship begins only after (a) an initial consultation, (b) you have reviewed and signed Helen's intake paperwork — which includes a Treatment Consent, Notice of Privacy Practices, Good Faith Estimate, and any applicable Telehealth Consent — and (c) Helen has formally accepted you onto her caseload.
The Site, contact form, email, and phone are not monitored 24/7 and are not a crisis response service.
You must be at least 18 years old to use the Site, contact the practice, or schedule services for yourself. If you are seeking services for a minor, please contact us directly to discuss whether a referral or alternative arrangement is appropriate.
Any therapy services Helen provides are governed by a separate written Treatment Agreement and intake paperwork you will review and sign before your first session. These Terms govern only your use of the Site — not the therapy relationship itself.
All content on the Site — text, design, photography, illustrations, logos, the practice name "The Healing Haven," and the underlying business identity "Helen DeLovely LCSW PLLC" — is owned by Helen DeLovely LCSW PLLC or used with permission. You may not copy, reproduce, distribute, republish, or repurpose any content without our prior written permission, except for personal, non-commercial reference.

When you submit the contact form, you are sharing information voluntarily so we can respond to your inquiry. We are not obligated to retain your submission long-term, and the act of contacting us does not obligate Helen to provide services, schedule a consult, or accept you as a client. The Healing Haven, operated by Helen DeLovely LCSW PLLC, offers a text-messaging (SMS) program for non-marketing customer care and service-related communications. Messages may include appointment confirmations and reminders, scheduling follow-up, consult follow-up, intake/admin reminders, and direct responses to service inquiries.
Checking the optional SMS consent box on the contact form is your affirmative consent to receive these non-marketing customer care text messages from Helen DeLovely LCSW PLLC. The SMS consent box is unchecked by default, and SMS consent is not required to submit the form or receive services.
Opt-out. You can cancel the SMS service at any time. Reply STOP to opt out. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

Frequency, rates & delivery. Message and data rates may apply. Message frequency varies based on your interactions with our service.
Carrier delivery notice. Carriers are not liable for delayed or undelivered messages.
Age. By using this service, you represent and warrant that you are at least 18 years of age. If you are under 18 years old, you may not use or access our services or opt into our messaging program.
Consent to receive text messages is not required to receive therapy services, and you are not required to provide a mobile number to submit our forms. Please do not send diagnoses, Medicaid IDs, detailed clinical information, payment information, or urgent/crisis information by text message.

The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free, or free of harmful components.
We make no warranty that the Site's content is accurate, complete, or current. Therapy outcomes vary by individual and are not guaranteed.
To the fullest extent permitted by Utah law, in no event will Helen DeLovely LCSW PLLC, The Healing Haven, Helen DeLovely, or any affiliated party be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising from your use of the Site — separate from any therapy relationship — will not exceed one hundred U.S. dollars ($100).
You agree to defend, indemnify, and hold harmless Helen DeLovely LCSW PLLC, The Healing Haven, Helen DeLovely, and any agents or affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising from (a) your use or misuse of the Site, (b) your violation of these Terms, or (c) your violation of any third party's rights.
The Site may link to third-party websites or resources, including 988, Psychology Today, scheduling tools, and telehealth platforms. These are provided for convenience only. We do not control, endorse, or assume responsibility for third-party content, security, or practices.
We may update these Terms at any time. The "Effective Date" at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
Before filing any formal claim, you agree to attempt informal resolution by emailing us at [email protected] with a clear description of the issue. We will respond within thirty (30) days. Many issues can be resolved without litigation.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
